Town Tech Backup – Terms of Use

These Terms of Use ("Terms") govern your use of the Town Tech Backup service ("Service"), a white-labeled version of the AFI.AI backup solution provided by Town Tech Inc. ("we", "us", "our"). By using this Service, you agree to be bound by these Terms.
1. Service Description
Town Tech Backup provides automated, secure cloud backup and recovery services for supported cloud platforms, including (but not limited to) Microsoft 365 and Google Workspace, using the underlying infrastructure and technology provided by AFI.AI.
2. Eligibility
You must be at least 18 years old to use this Service. By agreeing to these Terms, you represent and warrant that you have the authority to bind the organization or entity on whose behalf you are using the Service.
3. Account and Access
You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Data Protection and Privacy
We respect your privacy and the confidentiality of your data. All backup data is encrypted in transit and at rest. We do not access or use your data except as required to provide and maintain the Service or as required by law.
Your data is stored in data centers managed by AFI.AI or their providers, and may be located outside of your province or country.

5. Acceptable Use
You agree not to:
Use the Service for any illegal or unauthorized purpose.
Interfere with or disrupt the integrity or performance of the Service.
Attempt to gain unauthorized access to any part of the Service.
6. Service Availability and Support
We strive to provide high availability and performance, but we do not guarantee uninterrupted access to the Service. Scheduled maintenance or third-party disruptions may cause temporary unavailability.
Basic support is provided via email or support ticketing during regular business hours. Premium support may be available by separate agreement.
7. Billing and Payment
Fees for the Service are billed monthly or annually in accordance with your subscription plan. All fees are non-refundable unless otherwise stated.
Late or failed payments may result in suspension or termination of the Service.
8. Termination
You may cancel your subscription at any time. Upon cancellation, your access to the Service will end at the close of your billing cycle, and your backed-up data will be retained for [30 days] unless otherwise agreed.
We reserve the right to suspend or terminate your access if you violate these Terms.
9. Limitation of Liability
The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Town Tech Inc. shall not be liable for any indirect, incidental, or consequential damages, including loss of data or business interruption.
10. Changes to These Terms
We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes means you accept the revised Terms.
